These Terms of Service are an agreement between you and USA Service Dogs ("we," "us," "our") covering your use of usaservicedogs.org and everything you buy from us. Our Privacy Policy and Return Policy are part of this agreement.
You must be at least 18 years old to order from us. By placing an order you confirm that you are.
We are a private company. We are not a government agency, and we are not affiliated with, endorsed by, or acting on behalf of one.
There is no federal or state registry of service dogs or emotional support animals. Registration with us, and the ID cards, certificates and other items we sell, are not required by the Americans with Disabilities Act, the Fair Housing Act, or any other law. Nothing you buy from us creates a legal right you do not already have, and no business, landlord, airline or school is required to accept any of it.
What our products do is give you a convenient way to present information about your animal to people who ask. Your actual rights come from the law and from your disability and your animal's role, not from anything we issue.
You agree that the information you give us is true and accurate, and that you will keep it current. We rely on it to produce your items and ship them.
Several states make it a criminal offense, punishable by fines, to misrepresent an animal as a service animal or an emotional support animal in order to obtain housing or public access. You are responsible for the accuracy of what you tell us and what you represent to others.
Prices are shown on the site and may change. We may decline or cancel an order, including where an item is unavailable, where a price was listed in error, or where we believe the order is fraudulent. If we cancel an order you have paid for, we refund it.
Payment is processed by our payment provider. We do not receive or store your full card number.
Delivery estimates are estimates. Once a carrier has your package, delivery timing is outside our control. Risk of loss passes when the carrier takes possession, though we will work with you on anything that arrives damaged or does not arrive.
Our Return Policy governs returns, exchanges and refunds, and is part of this agreement.
This section applies if you purchase an emotional support animal evaluation.
You are purchasing an evaluation, not a letter. We refer you to an independent licensed mental health professional. That professional is not our employee. They exercise their own clinical judgment, keep their own records, and decide for themselves whether a letter is appropriate. We do not instruct them on outcomes and we do not pay them based on whether a letter is issued.
No letter is guaranteed. If the professional does not issue one, you are refunded the amount you paid less a $35 consultation fee for the clinician's time.
Availability varies by state. Some states restrict who may issue assistance animal documentation, or require an in-person evaluation or a pre-existing relationship with the clinician. We do not sell ESA evaluations in states where we cannot do so properly, and we may stop selling in a state at any time.
We do not guarantee acceptance. Whether a landlord, housing provider, HOA or school grants a reasonable accommodation is their decision, subject to the law. A letter supports a request; it does not decide it.
You keep ownership of any photo you upload. You give us permission to use it to produce and deliver what you ordered, and to keep it with your registration so we can reproduce or replace items later.
You confirm that you have the right to upload what you upload, and that it does not infringe anyone's rights. We may decline to use content that is unlawful or that we consider inappropriate.
The site, our text, images, designs and logos belong to us or our licensors. You may use them for your own personal, non-commercial purposes. You may not copy, resell or redistribute them, or use them in a way that suggests we endorse you.
We provide the site and our products "as is." To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose.
We do not provide legal advice. Information on our site about the ADA, the Fair Housing Act, airline rules or state law is general information, laws change, and how a law applies to your situation depends on facts we do not know. Do not rely on our site in place of advice from a lawyer or from the agency that administers the law.
We do not provide medical or mental health care. Any clinical service you receive comes from an independent licensed professional, not from us.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, arising out of your use of the site or our products. Our total liability for any claim is limited to the amount you paid us for the order the claim relates to.
Some states do not allow these limits, in which case they do not apply to you.
This section affects your legal rights. It requires most disputes to be resolved by individual arbitration rather than in court, and it waives your right to a jury trial and to take part in a class action. You may opt out within 30 days of your first order, as described in 12.7, and nothing else about your order changes if you do.
12.1 Let us try to fix it first. If you have a problem, contact us at orders@usaservicedogs.org or 888-656-3647 and give us 60 days to resolve it. Most things are settled this way. Neither of us may start an arbitration until that 60 days has passed.
12.2 Agreement to arbitrate. If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms, the site, or anything you buy from us will be resolved by binding individual arbitration rather than in court, except as stated in 12.3.
12.3 What is not covered. Either of us may bring an individual claim in small claims court instead. Nothing here prevents either of us from seeking injunctive relief in court for infringement or misuse of intellectual property, and nothing here prevents you from reporting a concern to a government agency or stops a government agency from bringing an action.
12.4 How arbitration works. Arbitration is run by the American Arbitration Association under its Consumer Arbitration Rules. You may choose to have the arbitration conducted by telephone or video, based on written submissions, or in person in the county where you live. An arbitrator can award the same individual relief a court could, and the arbitrator's decision is final.
12.5 We pay the fees. For any claim you bring, we pay the AAA filing, administration and arbitrator fees, except that you pay your own filing fee up to the amount it would cost to file in your local court, and except where the arbitrator finds your claim was frivolous. Each side pays its own attorneys' fees unless a law or the arbitrator says otherwise.
12.6 No class actions. You and we agree to bring claims only in an individual capacity. Neither of us may bring a class, collective or representative action, and the arbitrator may not consolidate or preside over claims for more than one person. You waive any right to a jury trial. If a court decides this paragraph is unenforceable as to a particular claim, then that claim, and only that claim, is decided in court rather than in arbitration.
12.7 How to opt out. You may opt out of this Section 12 by emailing orders@usaservicedogs.org with the subject line "Arbitration Opt-Out," including your name and order number, within 30 days of placing your first order. Opting out costs you nothing and changes nothing else about your order or your registration. If you opt out, disputes go to court as described in Section 13.
12.8 Many similar claims. If 50 or more similar arbitration demands are filed against us by or with the help of the same lawyers within a 90-day period, the AAA's rules for multiple consumer case filings apply, and the cases may be administered in batches. Any statute of limitations is paused for claims waiting in the queue.
12.9 Survival. This Section 12 survives the end of your relationship with us.
These Terms are governed by the law of the State of New York, without regard to its conflict of laws rules. For any dispute not subject to arbitration, you and we agree to the state and federal courts located in Nassau County, New York. Nothing in this section deprives you of the protection of consumer laws of the state where you live that cannot be waived by agreement.
We may update these Terms. We will change the date at the top, and if the change is significant we will give you more prominent notice. Changes do not apply to a dispute that arose before the change. If you do not agree to a change, stop using the site; your existing orders remain governed by the Terms in effect when you placed them.
If a provision of these Terms is unenforceable, the rest stays in effect. Our not enforcing something is not a waiver of it. You may not transfer this agreement; we may transfer it in connection with a sale of the business. These Terms, together with the Privacy Policy and Return Policy, are the entire agreement between you and us about their subject matter.
